Suspension of AT1 cases

By its interim decision of 22 October 2025, the Federal Administrative Court suspended all pending cases relating to the write-off of AT1 capital instruments, with the exception of case B-2334/2030.

In case B-2334/2023 on the write-off of AT1 capital instruments of the former Credit Suisse, the Federal Administrative Court (FAC) confirmed the complainants’ right to appeal in its partial decision of 1 October 2025, and revoked the decree of the Swiss Financial Market Supervisory Authority (FINMA) of 19 March 2023. The FAC has not yet decided on the reversal request. As previously announced in the media release dated 14 October 2025, by its interim decision published in the Federal Law Gazette on 22 October 2025, the FAC suspended all other pending cases until the Federal Supreme Court issues a decision in case B-2334/2023.
